IU publicly declares its ownership of a mark by placing a ® or ™ next to the trademark. The University must enforce its legal rights, or ultimately it will lose the ability to control the use of its marks. The Office of Licensing and Trademarks actively searches the marketplace for infringing goods.
A trademark infringement is unauthorized use or similar use of a trademark so as to cause the likelihood of confusion in the minds of the consumers as to the source.
